The primary duty of the Property Unit is to log, classify, store, dispense, destroy, and release property / evidence to its rightful owner, for court presentation, and/or for destruction or auction.

Evidence

  • After a criminal case has been adjudicated and all Defendants have been sentenced, evidence may be released to the owner, as long as certain conditions have been met. If the evidence was seized pursuant to a search warrant, a court order is required before the evidence can be released.

Found Property

  • The owner will be given 90 days to prove ownership and claim the property per CC 2080.1.
  •  All unclaimed property will be disposed of or auctioned.

Safekeeping

  • Property that is being held for safekeeping shall be returned to the legal owner upon request. Property not claimed within 60 days is to be considered intentionally abandoned by the owner and disposed of per CC 2080 – 2080.3.
